LEGAL — PRIVACY POLICY
LAST UPDATED 5 JULY 2026 · MELBOURNE, AUSTRALIA
We respect your privacy and handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what we collect, why, how we use and protect it, and the choices and rights you have.
01
INTRODUCTION
This Privacy Policy explains how FROM YOUR POCKET PTY LTD (ABN 43 654 720 108) trading as SESSION in PROGRESS ("SiP", "we", "us", "our") collects, uses, discloses, and protects your personal information. We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
"Personal information" means information or an opinion about an identified individual, or an individual who is reasonably identifiable. This policy applies to information we collect through our website, our booking and payment tools, our studios, and our production work.
02
INFORMATION WE COLLECT
The personal information we collect depends on how you interact with us. It may include:
—
Identity and contact details — your name, email address, phone number, and business or organisation name.
—
Booking and session information — the studio, service, dates, and preferences associated with your bookings, collected through our Booking Platform (Podyx).
—
Payment information — billing details and transaction records. Card payments are processed by our Booking Platform or payment provider; we do not store full card numbers ourselves.
—
Recordings and footage — audio, video, and photographs produced during your session, which may contain the personal information, image, and voice of you and your guests.
—
Correspondence — the content of enquiries, emails, and messages you send us.
—
Marketing preferences — your subscription status and communication choices.
—
Website and technical data — IP address, device and browser information, pages viewed, and analytics data collected via cookies and similar technologies.
03
SENSITIVE INFORMATION
We do not generally seek to collect sensitive information (such as health, racial or ethnic origin, or political or religious beliefs). However, the nature of podcasting means recordings may capture sensitive information that guests choose to share on air. Where this happens, we handle that content as part of your production and rely on the consents you are responsible for obtaining from participants. We will only collect sensitive information where it is reasonably necessary and with consent, or as otherwise permitted by law.
04
HOW WE COLLECT IT
We collect personal information in a range of ways:
—
Directly from you — when you enquire, book a session or tour, engage our services, or correspond with us.
—
Through our Booking Platform (Podyx) — when you make or manage a booking and payment.
—
Through our website — via forms, cookies, and analytics tools.
—
Through advertising platforms — when you interact with our ads on Meta or Google and are directed to our site.
—
From third parties — for example, when someone books a session or refers you on your behalf, or from publicly available sources.
Where it is lawful and practicable, you may deal with us anonymously or using a pseudonym — though we may be unable to provide certain services without the information we need to deliver them.
05
WHY WE COLLECT & USE IT
We collect, hold, and use personal information to:
—
provide and manage studio hire, production services, bookings, and tours;
—
process payments and issue tax invoices;
—
deliver, review, and provide access to your recordings and files;
—
communicate with you about your bookings, projects, and enquiries;
—
send you marketing and updates where you have not opted out;
—
promote our work, with your permission and consistent with our Terms of Service;
—
improve our services, website, and client experience; and
—
meet our legal, tax, and regulatory obligations.
06
COOKIES & WEBSITE ANALYTICS
Our website uses cookies and similar technologies to help it function, remember your preferences, and understand how visitors use the site. We use analytics and advertising tools — which may include Google Analytics and the Meta Pixel — to measure traffic and the performance of our advertising.
You can control or disable cookies through your browser settings, and opt out of certain analytics and advertising tracking through the relevant provider’s tools. Disabling cookies may affect how parts of the site work. Where required, we will seek your consent to non-essential cookies through a cookie notice on the site.
07
DIRECT MARKETING
We may send you marketing communications — such as journal updates, offers, and news — where you have subscribed or where it is otherwise permitted under the Privacy Act and the Spam Act 2003 (Cth). Every marketing email includes an unsubscribe option, and you can opt out at any time by using it or by contacting us. We will action opt-out requests within a reasonable period.
08
WHO WE SHARE IT WITH
We do not sell your personal information. We may disclose it to:
—
Service providers who help us operate — including our Booking Platform (Podyx), delivery platform (Frame.io), remote-recording tools (Riverside.fm), payment providers, hosting, email, and analytics providers — for the purposes described in this policy;
—
the public, in promotional materials, only where you have granted permission under our Terms of Service and, for client logos, on a confirmed case-by-case basis;
—
professional advisers such as our accountants or lawyers, where reasonably required; and
—
others where required or authorised by law, or to protect our rights, safety, or property.
09
OVERSEAS DISCLOSURE
Some of our service providers store or process data outside Australia. For example, our platform, analytics, and advertising providers may host information in the United States or other countries.
Where we disclose personal information to overseas recipients, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles, including through the contractual and security commitments of those providers. By using our services, you acknowledge that your information may be stored or processed overseas by these providers.
10
RECORDINGS, GUESTS & THIRD PARTIES
Podcast production means we handle audio, video, and images that may include the personal information of you, your guests, and other participants. You are responsible for obtaining the consents needed from your guests and participants for their appearance and for the recording and later use of that content, as set out in our Terms of Service.
We handle recordings and project files as your production materials — keeping them confidential and using them only to deliver your work, and for promotion only where permission has been granted. If a guest or participant has a concern about their appearance in content we have produced, they can contact us and we will work with you to address it appropriately.
11
DATA SECURITY & BREACHES
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure — including access controls, reputable platforms, and secure delivery tools. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
We comply with the Notifiable Data Breaches scheme under the Privacy Act. If a data breach is likely to result in serious harm to affected individuals, we will notify those individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.
12
HOW LONG WE KEEP IT
We keep personal information only for as long as we need it for the purposes described in this policy, or as required by law (for example, tax and financial records). Recordings and project files are retained for the period notified to you and may be deleted after that period — you are responsible for downloading and keeping your own copies. When information is no longer needed, we take reasonable steps to destroy or de-identify it.
13
ACCESS & CORRECTION
You have the right to request access to the personal information we hold about you, and to ask us to correct it if it is inaccurate, out of date, incomplete, or misleading. To make a request, contact us using the details below. We will respond within a reasonable period and may need to verify your identity. Where we decline a request, we will explain why, as permitted under the Australian Privacy Principles.
14
COMPLAINTS
If you believe we have mishandled your personal information or breached the Australian Privacy Principles, please contact our Privacy Officer using the details below. We take complaints seriously and will acknowledge and investigate your concern, and respond within a reasonable timeframe.
If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992.
15
